From the Oregon Liquor Control Commission:
The sale of recreational marijuana products at Oregon Health Authority (OHA) medical marijuana dispensaries ended on December 31, 2016. The end of “early start” sales means that beginning January 1, 2017 only Oregon Medical Marijuana Program cardholders are legally allowed to purchase marijuana products from OHA registered dispensaries.
Consumers can continue to purchase recreational marijuana products from Oregon Liquor Control Commission licensed retailers, and OMMP cardholders may purchase medical grade marijuana products from authorized licensed OLCC retailers.
Beginning January 1, 2017 OHA dispensaries planning to become OLCC retailers, are NOT allowed to sell recreational marijuana, until they surrender their OHA registration, and activate their OLCC license. Failure to comply will be criteria for denial of an OLCC recreational marijuana license, as well as subjecting a dispensary to separate sanctions by the OHA.
TEMPORARY RULES TAKE EFFECT JANUARY 1, 2017
Shared Commercial Kitchen Space
The OLCC has approved temporary rules to expand the practice of licensed processors to share commercial kitchen space. This practice had been allowed for processors with an edible endorsement; it is being expanded to accommodate edible makers that also produce their own infused butter, which requires a concentrate endorsement.
Oregon Department of Agriculture Marijuana Compliance Program
The OLCC also approved a rule to align with changes made by the Oregon Department of Agriculture (ODA) regarding pesticide violations. ODA is establishing the Marijuana Compliance Assistance Program which allows marijuana produces to accept responsibility for an illegal pesticide application and receive a warning instead of a Category I violation. Subsequent violations would trigger a Category I violation, which could result in cancellation of the license.
These temporary rules become effective on January 1, 2017.
OLCC LICENSEES: MARIJUANA WORKER PERMIT REQUIREMENTS
Compliance Checks Begin January 1, 2017
All individuals employed by OLCC recreational marijuana licensees are required to obtain OLCC Marijuana Worker Permits. Licensees, not an employee, are responsible for ensuring that the employees working for the licensee have been issued a Marijuana Worker Permit; individuals are required to have the permit in their possession when working at the licensed business.
Beginning January 1, 2017 OLCC inspectors will begin routinely asking licensees to produce their employee rosters along with the required employee permits.
